Welcome to NOLA Health Pro CRM (“Company,” “we,” “our,” or “us”). These Terms of Use ("Terms") govern your access to and use of https://nolahealthprocrm.com/ (the “Site”) and any related services, including SMS/MMS messaging via A2P 10DLC. By using our services, you agree to these Terms. If you do not agree, do not use the Site or Services.

1. Use of Services

You must be at least 18 years old to use our Services. You agree to provide accurate, complete, and current information when registering and using the platform.

Our CRM is intended for healthcare and weight loss clinics. You are solely responsible for all messages and content sent through your account.

2. User Responsibilities

You agree to:

  • Use the service in accordance with all applicable laws and industry regulations, including HIPAA if applicable.

  • Obtain appropriate consent from contacts before sending messages.

  • Immediately honor opt-out requests (e.g., “STOP”).

  • Refrain from using shared accounts or unauthorized access.

3. A2P 10DLC Compliance & Messaging

To use SMS/MMS messaging, you must register with A2P 10DLC through our platform or provide your own registration details.

Opt-in Requirements

You must obtain clear and documented consent from users before sending A2P 10DLC messages.

Acceptable opt-in methods include:

  • Web forms with checkboxes (not pre-selected)

  • Text-based keywords (e.g., “Text JOIN to 12345”)

  • Paper forms or point-of-sale opt-ins

Opt-out Requirements

  • Your messages must clearly inform users how to opt out (e.g., “Reply STOP to unsubscribe”).

  • You must stop sending messages immediately upon opt-out.

4. Prohibited Content (SHAFT & Others)

The following are strictly prohibited:

  • Sexually explicit content

  • Hate speech or harassment

  • Alcohol, tobacco, or cannabis content without proper age-gating and carrier approval

  • Firearms, ammunition, or weapons

  • Trafficking, fraud, or misleading claims

Additionally, any spam, phishing, or unverified medical claims are not permitted. Violations may result in suspension or termination.

5. Carrier and Legal Compliance

You must comply with:

  • CTIA Messaging Principles and Best Practices

  • TCPA (Telephone Consumer Protection Act)

  • HIPAA, where applicable

  • FTC and FCC rules

Failure to comply may lead to legal action, account suspension, or carrier blacklisting.

6. Consequences of Misuse

Misuse of the messaging platform, including but not limited to violations of A2P 10DLC rules, SHAFT content, or privacy laws, may result in:

  • Immediate suspension or termination of your account

  • Legal liability

  • Notification to carriers and regulators

  • Forfeiture of remaining credits or service fees

Failure to comply may lead to legal action, account suspension, or carrier blacklisting.

7. Limitation of Liability

We are not liable for any direct or indirect damages related to the use of the Site or Services, including delivery delays or carrier filtering.

8. Governing Law

These Terms shall be governed by the laws of the State of Louisiana, without regard to conflict of law principles. Any legal actions shall be resolved in courts located in New Orleans, Louisiana.
